Procedure for Levying Covenant Violation Fines

In December 2008, the Addie's Pond HOA approved and amended the neighborhood
covenants to give the HOA Board the authority to levy fines on those homeowners who are in
non-compliance with the covenants.
The procedure for implementing that authority in the event of a covenant violation will be as
follows:

1. The Architectural Control Committee (ACC) will issue a “friendly reminder” in writing to
the homeowner notifying them of the violation.

2. If there is no response from the homeowner, or the homeowner has not corrected the
violation, the ACC will:

a. Send a second letter referencing the violation and advising of the Board's ability to
levy a fine if corrective action is not taken,
b. Make direct contact, or
c. Attempt to obtain an agreement for a date to complete the corrective action.

3. If the violation has not been addressed by either correcting or making arrangements to
correct the violation, the ACC will refer the violation to the Board.

4. The HOA board will review the violation and determine whether a fine should be
imposed.

5. If a fine is to be levied, the HOA Board will send a letter to the homeowner reviewing
the violation and notifying them of the date on which the fine will begin to accrue if no
corrective action is taken. The Board has determined that the fine for covenant
violation will be $25 per day.

6. The HOA Board will continue to maintain the accounting of the fines until the ACC
submits written notification that the violation has been corrected.
Note: If the violation is deemed offensive to a neighbor or the neighborhood, the ACC will
initiate direct contact with the homeowner immediately and advise of the possibility of a fine.
